These Terms and Conditions (“Terms”) govern your use of Charter Secrets services and website. Charter Secrets is a website/brand owned by GREEK ISLES YACHTING (ELLINIKA NISIA NAVLOSEIS ORTOLANO-ABELA & SIA EE), a company registered in Greece.

Please read these Terms carefully before using our Service. By using the Service, you agree to be bound by these Terms and Conditions.

Interpretation and Definitions

Interpretation

The words of which the initial letter is capitalized have meanings defined under the following conditions. The following definitions shall have the same meaning regardless of whether they appear in singular or plural.

Definitions

For the purposes of these Terms and Conditions:

  • Lessor refers to the yacht owner or their authorized representative providing the yacht for charter.
  • Lessee (also referred to as “Charterer” or “you”) refers to the individual or entity renting the yacht.
  • Company (referred to as either “Charter Secrets”, “We”, “Us” or “Our”) refers to GREEK ISLES YACHTING (ELLINIKA NISIA NAVLOSEIS ORTOLANO-ABELA & SIA EE).
  • Service refers to the yacht charter booking and related services provided through our website.
  • Charter Agreement means the contract between the Lessor and Lessee for the rental of a yacht.
  • Website refers to Charter Secrets, accessible from https://chartersecrets.com

Charter Agreement Terms

Booking and Payment

The following terms apply to all charter bookings:

  • A 50% down payment is required within 5 days of contract conclusion
  • The remaining balance is due six weeks before the charter start
  • Cancellation fees:
    • Up to 2 months before charter: Down payment amount
    • Less than 2 months before charter: 100% of charter price

Lessor’s Obligations

  • Provide a clean, seaworthy, and fully fueled yacht
  • Offer equivalent replacement if original yacht is unavailable

Lessee’s Obligations

  • Adhere to good seamanship principles
  • Possess necessary sailing qualifications or hire qualified skipper
  • Comply with local maritime laws and regulations
  • Use yacht only for recreational purposes
  • Stay within agreed sailing area
  • Maintain yacht in good condition
  • Report any damages or incidents promptly

Safety and Maintenance

Weather Conditions

The lessee must not leave a protective harbor in forecasted winds of 7 Beaufort or higher.

Equipment Monitoring

The lessee must regularly monitor:

  • Oil levels
  • Cooling water
  • Bilges
  • Other essential systems

Liability and Insurance

Lessor’s Liability

  • Limited to intentional or gross negligence
  • Excludes nautical material inaccuracies
  • Covers injury to life, body, or health caused by negligent or intentional breach of duty

Security Deposit

A security deposit is required at check-in:

  • Usually paid via credit card in local currency
  • Released within 14 days after check-out if no damages
  • May be used for repairs or replacement of damaged equipment

Legal Framework

Jurisdiction

  • Agency claims: Subject to agency’s location law
  • Lessor claims: Subject to lessor’s location law

Right of Withdrawal

No statutory right of withdrawal exists for distance contracts related to leisure activities with specific dates. Cancellation terms apply upon contract conclusion.
